General Terms and Conditions of Participation – FACTQRY Participatory Brand

The purpose of these general terms and conditions is to define the terms of participation in the "FACTQRY – The Participatory Brand" concept and the rights and obligations of both the participants and the company FACTQRY.
By participating in this concept, the customer acknowledges having read, understood, and accepted the terms below without reservation.
1. Purpose of the concept
FACTQRY invites consumers to submit product ideas in several ways:
- either a simple idea, described in text,
- or a file or design that can be used for commercial purposes.
Accepted creations may give rise to remuneration under the conditions specified below.
2. Terms of remuneration
- Initial 6-month period :
During the first six (6) months following the launch of the concept, any remuneration will be paid in the form of vouchers valid on the FACTQRY website.
- After the initial period :
If the concept is deemed viable by FACTQRY, remuneration will be paid in cash according to the terms that will be communicated to participants.
3. Amount and conditions of award
- Submission of a usable design :
If the participant provides a usable design and it is directly used for the production and sale of a product, they will receive €2 per sale made.
- Submission of a text-only idea :
If the participant only proposes an idea without a design, and FACTQRY creates a similar visual or design, no remuneration will be owed to the participant.
FACTQRY therefore strongly recommends that participants submit files to guarantee their remuneration.
4. Attribution and sales tracking
In the event of a dispute concerning the attribution of sales or the calculation of remuneration, the participant is invited to contact FACTQRY at the following address:

FACTQRY commits to seeking an amicable solution with the participant.
5. Intellectual property
By submitting a file or design:
-the participant exclusively assigns to FACTQRY all rights of reproduction, representation, adaptation, and commercial exploitation of the design,
-for the whole world,
-for the entire legal duration of copyright protection.
The participant guarantees that their design is original and does not infringe any third-party rights (trademark, copyright, etc.).
6. Responsibilities
FACTQRY cannot be held liable for:
- data loss due to technical failure,
- delays or errors in the payment of remuneration due to incorrect banking information provided by the participant,
- any fraudulent use of the design by unauthorized third parties.
7. Personal data protection
FACTQRY is committed to complying with GDPR regulations regarding the protection of personal data.
The information collected within the framework of participation is strictly confidential and will only be used for:
- managing participation,
- paying remuneration,
- communicating with the participant.
The participant may exercise their rights (access, rectification, deletion) by writing to constant@factqry.com.
8. Applicable law and competent jurisdiction
These terms are subject to French law.
In the event of a dispute and in the absence of an amicable agreement, the French courts shall have exclusive jurisdiction.
9. Acceptance of terms
By submitting an idea or a file, the participant acknowledges having read and accepted these general terms and conditions of participation without reservation.
