Terms of sale
These Terms and Conditions of Sale (the "Terms") govern sales made on the website factqry.com between FACTQRY (Constant Lemazurier, sole trader, SIRET 911 960 185 00021, constant@factqry.com; full details in our legal notice) and its consumer customers.
Placing an order on the website implies full acceptance of these Terms.
1. Products
The products offered for sale are textile items (T-shirts, sweatshirts, etc.) printed on demand, with or without personalization.
The images shown on the website are for illustration purposes. Slight variations in color or rendering may occur depending on screens and printing techniques.
2. Personalized products
Design created from a photo or an image: the customer is contacted by email. Up to 3 mockup proposals may be sent before production starts. Production begins only after the customer has approved the design.
Text-only personalization: no mockup is sent before production, unless the customer requests one when ordering. The order is processed according to the personalization details provided at the time of purchase.
3. Customer responsibility: files sent
When the customer sends files (photos, images, designs), they guarantee that they hold all the rights required to use them.
The company cannot be held liable if files are sent without authorization or in breach of third-party rights. It reserves the right to refuse a personalization if the files sent do not allow a correct or compliant use.
4. Prices
Prices are shown in euros (€). VAT not applicable, article 293 B of the French General Tax Code. The price applied is the one in force when the order is confirmed. Delivery costs are shown before the order is confirmed.
5. Payment
The accepted payment methods are those offered by Shopify (bank card, PayPal, Shop Pay, etc.). An order that has not been paid in full will not be shipped until full payment has been received.
6. Delivery
Delivery methods, rates and times are detailed in our Shipping Policy and shown again before the order is confirmed. The company commits to shipping within 48 business hours after payment is confirmed, or after the design is approved for a personalization based on a photo (up to 7 business days during busy periods). The delivery time then depends on the carrier.
7. Right of withdrawal and cancellation
For non-personalized products, the customer has 14 days from receipt of their order to exercise their right of withdrawal, without having to give any reason. Return shipping costs are at the customer's expense: on request, the company sends a return label, whose cost is deducted from the refund.
The refund is made within 2 days of receiving the returned product and no later than 14 days after receiving the withdrawal decision; it may be withheld until the product has been received or until the customer has provided proof of having sent it back. It includes the original delivery costs, up to the cheapest standard delivery rate offered.
Under Article L221-28, 3° of the French Consumer Code, this right does not apply to products made to the customer's specifications or clearly personalized (photo, text, name, date or any other element chosen by the customer). An order for a personalized product may be cancelled as long as production has not started; if the shipping label has already been created, delivery costs are not refunded.
This exclusion does not deprive the customer of the legal guarantees provided for in article 8. Practical details are set out in our Return and Refund Policy.

8. Legal guarantees
The products are covered by:
- the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code);
- the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
In addition, the customer has a 35-day return period from receipt for a product that is defective or does not match their order: exchange or full refund, with delivery and return costs paid by the company (see the Return and Refund Policy).
9. Force majeure
The company cannot be held liable for any delay or failure to perform resulting from a force majeure event beyond its control.
10. Mediation and applicable law
These Terms are governed by French law.
In accordance with articles L.612-1 et seq. of the French Consumer Code, the customer may use the following mediator free of charge: CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net.
11. Changes to these Terms
FACTQRY reserves the right to change its terms of sale at any time. The applicable terms are those in force on the date of the order.
